Grosfillex Americas Limited Warranty

The warranty periods applicable to Grosfillex Americas products and components are identified in the Warranty Coverage Chart. Warranty coverage begins on the original date of purchase and is subject to the terms, conditions, limitations, and exclusions outlined below.
This Limited Warranty is provided by Grosfillex Americas, 230 Old West Penn Ave, Robesonia, PA 19551, and extends only to the original end-use purchaser. This Limited Warranty is non-transferable.
LIMITED WARRANTY
This warranty is limited to the repair or replacement of products or parts of products that have a manufacturing defect during the applicable warranty period. For approved warranty claims, Grosfillex will provide the applicable replacement product, component, or part at no charge, along with standard freight/shipping. If replacement parts are unavailable or the product is determined to be unrepairable, a replacement product or equivalent will be provided at no charge. Unless otherwise stated, labor, removal, installation, disposal, expedited shipping, and other related costs are not covered.
If the exact model, color, component, or product is no longer available, Grosfillex Americas reserves the right to replace it with a comparable product or component.
If a product is determined to be unrepairable and is replaced under this warranty, the customer is responsible for removing the original product from service and disposing of it in a conscientious manner.

Proof of purchase and additional documentation may be required to establish the original purchase date, identify the product, and evaluate warranty eligibility.
HOW TO MAKE A WARRANTY CLAIM
To obtain performance under this Limited Warranty, the original end-use purchaser should follow the steps below:
1. Contact your local Grosfillex Americas dealer or sales representative, or Grosfillex Americas Customer Sales and Service at (800) 233-3186 or gfxcustomerservice@Grosfillexamericas.com. Written claims may be sent to Grosfillex Americas, 230 Old West Penn Ave, Robesonia, PA 19551.
2. Provide proof of purchase, product identification, photographs of the product and reported condition, and information regarding the circumstances in which the issue occurred. Grosfillex Americas may request additional information reasonably necessary to evaluate the claim.
3. Grosfillex Americas will review the information provided and advise whether the reported condition is covered by the applicable warranty and, if covered, whether the warranty remedy will be repair, replacement, or a comparable product or component when the exact item is no longer available.
4. Once the information reasonably necessary to evaluate the claim has been received, Grosfillex Americas will perform an approved warranty obligation.
5. Grosfillex Americas may require the product to be returned or made available for physical inspection when reasonably necessary to evaluate the warranty claim.
6. Warranty claims must be initiated through an authorized Grosfillex dealer or sales representative, or by contacting Grosfillex Customer Sales & Service at (800) 233-3186 or gfxcustomerservice@Grosfillexamericas.com. Products should not be returned without prior authorization from Grosfillex. If a product return is required, Grosfillex will provide return instructions and identify responsibility for any applicable shipping or freight costs. Only Grosfillex or a party expressly authorized by Grosfillex may approve or perform obligations under this warranty.
IMPLIED WARRANTIES
ANY IMPLIED WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE SHALL BE LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD OF THE SPECIFIC PRODUCT FROM THE ORIGINAL DATE OF PURCHASE.
Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
NAUTICAL PRO, NAUTICAL, MARINA & CATALINA CHAISES
If the resin frame or backrest of a Nautical Pro, Nautical, Marina, or Catalina chaise fails structurally or discolors, under normal intended use within three (3) years from the original date of purchase, Grosfillex Americas will repair or replace the affected frame or backrest without charge.
The sling fabric on these chaises is warranted for one (1) year from the original date of purchase against discoloration or fading resulting from exposure to the sun's ultraviolet (UV) rays. Grosfillex Americas will provide replacement fabric at no charge for an approved warranty claim; labor associated with replacement of the fabric is not included.
This warranty does not cover color changes resulting from staining, improper cleaning, misuse, or other conditions not attributable to a manufacturing defect. Refer to Grosfillex Americas cleaning and care instructions for recommended product maintenance.
WARRANTY EXCLUSIONS AND REASONS FOR CLAIM DENIAL
Warranty coverage applies only to conditions that are manufacturing defects. A warranty claim may be denied if the reported condition is not covered by the applicable warranty or if sufficient information is not provided to evaluate the claim.
1. The reported issue is not the result of a manufacturing defect.
Warranty coverage does not apply when the condition or damage is attributable to:
• Normal wear and tear associated with the use or age of the product;
• Damage caused by external impact, collision, crushing, dropping, blunt force, accident, or other external force;
• Abuse, misuse, neglect, or improper handling;
• Use of the product in a manner inconsistent with its intended purpose or Grosfillex Americas instructions;
• Loads, weight, stress, or use exceeding the designed capacity of the product;
• Improper assembly, installation, maintenance, cleaning, or storage;
• Unauthorized alterations or modifications to the product; or
• Repairs or alterations performed after the product has left Grosfillex Americas facilities, but only where Grosfillex can demonstrate that the repair or alteration caused or contributed to the reported condition.
2. Sufficient information or documentation has not been provided.
Grosfillex Americas may require information reasonably necessary to evaluate a warranty claim, including proof of purchase, product identification, photographs of the product and reported condition, information regarding the circumstances in which the issue occurred, and when reasonably necessary, physical inspection of the product.
A warranty claim may be denied if sufficient information or documentation is not provided to verify warranty eligibility or reasonably determine the nature and cause of the reported condition.
3. The warranty claim falls outside the applicable warranty terms.
A warranty claim may be denied if:
• The applicable warranty period has expired;
• The product or component is not covered by the warranty being claimed;
• The reported condition is specifically excluded from warranty coverage; or
• The claim otherwise does not meet the terms and conditions of this Limited Warranty.
LAST CHANCE AND OPPORTUNITY BUY PRODUCTS
Products designated and sold as “Last Chance” or “Opportunity Buy” are excluded from Grosfillex Americas’ standard Limited Warranty and are sold “AS IS,” to the extent permitted by applicable law.
The standard warranty periods identified in the Warranty Coverage Chart do not apply to products sold under a Last Chance or Opportunity Buy designation.
LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY APPLICABLE LAW, GROSFILLEX AMERICAS SHALL NOT BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF ANY DEFECT IN GROSFILLEX AMERICAS PRODUCTS.
Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
